Bedingungen
Since 1 January 2018, a transgender person no longer needs to meet certain medical conditions to have their gender and first name officially adjusted on the deeds of civil status and in the population register.
From the age of 16, minors can also have the gender registration on the birth certificate adjusted if they are assisted by their parents or legal representative. They must then also be able to provide a declaration from a child and adolescent psychiatrist confirming that this is a free and conscious choice.
Proof
- your identity document
- your signed declaration (you can find the documents on the FPS Justice website)
Procedure
Procedure
The procedure consists of two steps: the declaration and the preparation of the deed.
Declaration
You hand in a declaration to the Civil Affairs Office of your municipality stating that you have been convinced for some time that the gender mentioned on the birth certificate does not correspond to your inner gender identity. In the declaration, you confirm that you wish this to be adjusted administratively and legally.
The municipality will provide you with a receipt and more information about the further course of the procedure and the administrative and legal consequences of the adjustment.
Drawing up the deed
You appear a second time before the Civil Affairs Office and confirm your first declaration, minimum 3 and maximum 6 months after the declaration. You present a second declaration confirming your previous conviction. With this declaration, you also confirm that you are aware of the administrative and legal consequences and the irrevocable nature of the change of sex registration.
Thereafter, the Civil Affairs Office will prepare the gender registration adjustment deed.
Legislation
Law of 25 June 2017 reforming regulations on transgender people as regards the indication of an adjustment of gender registration in civil status records and its consequences (B.S. 10 July 2017)
